PartyGram Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of PartyGram websites, event pages, communications, applications, and related services provided by PartyGram LLC (“PartyGram,” “we,” “us,” or “our”).
By accessing or using PartyGram, you agree to these Terms.
1. Privacy
Please review our Privacy Policy for information about how PartyGram collects, uses, and protects personal information.
2. PartyGram
PartyGram provides tools that allow users to create, manage, share, and participate in events.
Features may include:
- Event pages
- Invitations
- RSVP management
- Event communications
- Questionnaires
- Potlucks
- Wishlists
- Interactive event activities
- Design and customization features
- Other event-planning tools
PartyGram provides the technology used to facilitate events. PartyGram is not the organizer, host, venue, or operator of events created by users unless expressly stated otherwise.
3. Eligibility and Accounts
You must provide accurate information when creating or using a PartyGram account.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
You may not use PartyGram for unlawful, fraudulent, abusive, deceptive, or harmful purposes.
4. Event Hosts
If you create or manage an event through PartyGram, you are responsible for:
- The accuracy of your event information
- Determining who should be invited
- Content you publish or submit
- Communications you request PartyGram to send
- Complying with laws applicable to your event
- Obtaining any permissions necessary to provide information about other people to PartyGram
You may not use PartyGram to send unsolicited commercial messages, spam, harassment, or deceptive communications.
5. Guest Information and Invitations
Event hosts may provide PartyGram with contact information for known friends, family members, or other personal contacts for the purpose of sending event invitations.
When you provide another person's phone number, email address, or other contact information, you represent that you have a legitimate event-related purpose for providing that information and that you will use PartyGram's invitation features in accordance with these Terms and applicable law.
PartyGram may limit, suspend, or block invitation activity that appears abusive, fraudulent, automated, or inconsistent with the intended use of the service.
6. SMS Messaging Terms
PartyGram may provide SMS messaging for event invitations and event-related notifications.
A host may request that PartyGram send a one-time transactional event invitation to a known personal contact.
After a recipient interacts with PartyGram, the recipient may separately choose to opt in to ongoing event-related SMS messages from PartyGram and PartyGram event hosts who invite that phone number, including:
- RSVP reminders
- Event updates
- Host announcements
- Day-of-event reminders
- Other transactional event notifications
For ongoing SMS messaging:
- Message frequency varies depending on the event and host activity.
- Message and data rates may apply.
- Reply STOP to opt out.
- Reply HELP for help.
Opting out of SMS does not necessarily prevent a user from participating in an event through PartyGram by other means.
Consent to ongoing SMS messaging is voluntary and, where presented as an option, is not required to complete unrelated transactions or actions on PartyGram. Twilio’s campaign-review standards specifically require SMS consent on web/app flows to be voluntary and separable from required actions.
Wireless carriers are not liable for delayed or undelivered messages.
PartyGram may use third-party telecommunications providers to transmit messages.
7. SMS Opt-Outs
Recipients may revoke SMS consent at any time by replying STOP.
After an opt-out request is processed, PartyGram will stop sending SMS messages covered by that opt-out unless the recipient later takes an affirmative action to re-enroll where permitted.
Recipients may reply HELP for assistance.
8. User Content
You may submit content through PartyGram, including:
- Event descriptions
- Images
- Questions
- Responses
- Potluck items
- Wishlist items
- Announcements
- Other event-related materials
You retain ownership of content you submit.
You grant PartyGram a limited, non-exclusive license to host, store, reproduce, display, transmit, resize, process, and otherwise use that content as reasonably necessary to operate and provide PartyGram.
You represent that you have the necessary rights to content you upload.
9. Prohibited Conduct
You may not use PartyGram to:
- Violate applicable law
- Harass, threaten, or abuse others
- Send spam or unsolicited commercial messages
- Impersonate another person or organization
- Upload malicious software
- Attempt unauthorized access to PartyGram systems
- Interfere with PartyGram's operation
- Scrape or harvest personal information without authorization
- Use the service for fraudulent or deceptive activity
- Infringe intellectual-property or privacy rights
10. Paid Services
PartyGram may offer paid features or services.
Prices and features will be disclosed before purchase.
Unless otherwise stated, fees associated with a particular event or feature apply only to that purchase and do not create a recurring subscription.
Taxes may be added where required.
Payments may be processed through third-party payment processors. PartyGram does not necessarily receive or store complete payment-card information.
11. Cancellations and Refunds
Refund eligibility, if any, may depend on the service purchased and whether the associated service has already been provided or communications have already been sent.
PartyGram may provide additional refund terms at the time of purchase.
Nothing in these Terms limits rights that cannot legally be waived.
12. Third-Party Services
PartyGram may integrate with or link to third-party services.
Your use of those services may be governed by separate terms and privacy policies.
PartyGram is not responsible for third-party products or services outside our control.
13. Intellectual Property
PartyGram and its software, branding, designs, logos, interfaces, and other proprietary materials are owned by PartyGram LLC or its licensors and are protected by applicable intellectual-property laws.
These Terms do not grant you ownership of PartyGram intellectual property.
14. Service Availability
We may modify, suspend, or discontinue parts of PartyGram at any time.
We do not guarantee that PartyGram will always be available, uninterrupted, error-free, or compatible with every device or service.
15. Events and User Conduct
PartyGram does not control events created by users.
Hosts are responsible for their events, including safety, legality, location, attendees, activities, food, alcohol, transportation, accommodations, and other event-related matters.
Participation in an event is at the participant's own discretion and risk.
16. Disclaimer of Warranties
To the extent permitted by law, PartyGram is provided “as is” and “as available.”
We disclaim warranties not expressly provided in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
17. Limitation of Liability
To the maximum extent permitted by law, PartyGram LLC and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of PartyGram.
Any additional limitations required for PartyGram's specific business structure should be reviewed by legal counsel before launch.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless PartyGram LLC from claims, damages, liabilities, losses, and expenses arising from your misuse of PartyGram, violation of these Terms, infringement of third-party rights, or events you organize through the service.
19. Termination
PartyGram may suspend or terminate access to the service when reasonably necessary for:
- Violations of these Terms
- Fraud or abuse
- Security concerns
- Legal or regulatory requirements
- Conduct that poses risk to PartyGram or others
You may stop using PartyGram at any time.
20. Changes to These Terms
We may update these Terms periodically.
When material changes are made, we may provide notice through PartyGram or other reasonable means.
Continued use after revised Terms become effective constitutes acceptance where permitted by law.
21. Governing Law
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable law requires otherwise.
